1. Scope
1.1 These General Terms and Conditions of Sky Fox GmbH, hereinafter referred to as “SKY FOX” or “Seller”, apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur with the Seller regarding the goods displayed in the online shop. The inclusion of the customer’s own terms and conditions is hereby rejected unless otherwise agreed.
1.2 These Terms and Conditions apply accordingly to contracts for the delivery of vouchers, unless otherwise regulated.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
1.4 An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.
2. Conclusion of Contract
2.1 The product descriptions contained in the online shop do not constitute binding offers by the Seller, but serve to enable the customer to submit a binding offer.
2.2 The customer may submit the offer via the online order form integrated into the online shop. By clicking the button that completes the order process, the customer submits a legally binding contractual offer. The customer may also submit the offer to the Seller by email, fax, online contact form, post or telephone.
2.3 The Seller may accept the customer’s offer within five days by sending the customer a written order confirmation or an order confirmation in text form, by delivering the ordered goods, or by requesting payment from the customer after the order has been placed.
2.4 If a payment method offered by PayPal is selected, payment processing is carried out via PayPal. If the customer pays using a PayPal payment method available during the online ordering process, the Seller declares acceptance of the customer’s offer at the time the customer clicks the button that completes the order process.
2.5 If Amazon Payments is selected as the payment method, payment processing is carried out via Amazon Payments Europe s.c.a. In this case, the Seller declares acceptance of the offer at the time the customer initiates the payment process.
2.6 The contract text is stored by the Seller after conclusion of the contract and sent to the customer in text form after the order has been submitted.
2.7 Before submitting a binding order, the customer can identify possible input errors and correct their entries using the usual keyboard and mouse functions.
2.8 The languages available for conclusion of the contract are displayed in the online shop.
2.9 Order processing and communication generally take place by email. The customer must ensure that the email address provided is correct and that emails sent by the Seller can be received.
3. Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the Seller’s cancellation policy.
3.3 The right of withdrawal does not apply to consumers who, at the time the contract is concluded, are not citizens of a member state of the European Union and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.
4. Prices and Payment Terms
4.1 Unless otherwise stated in the product description, the prices indicated are total prices including statutory VAT. Any additional delivery and shipping costs are stated separately.
4.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases, which must be borne by the customer, such as customs duties, taxes or bank transfer fees.
4.3 The available payment methods are communicated to the customer in the online shop.
4.4 If advance payment by bank transfer has been agreed, payment is due immediately after conclusion of the contract, unless a later due date has been agreed.
4.5 If a payment method offered via Klarna is selected, payment processing is carried out via Klarna. Further information is available at https://skyfox.com/service/zahlungsformen/.
4.6 If payment by credit card is selected, the invoice amount is due immediately upon conclusion of the contract. Credit card payment is processed via PAYONE GmbH.

Any bank charges for the transfer shall be borne by the buyer.
For B2B customers, shipping costs amount to a flat rate of EUR 7.95 including 19% VAT, unless otherwise stated during the ordering process.
5. Delivery and Shipping Conditions
5.1 Delivery is made within the specified delivery area to the delivery address provided by the customer, unless otherwise agreed.
5.2 If delivery fails for reasons attributable to the customer, the customer shall bear the reasonable costs incurred as a result.
5.3 If the customer acts as an entrepreneur, the risk of accidental loss and accidental deterioration of the goods passes to the customer as soon as the Seller has handed the goods over to the transport company.
5.4 The Seller reserves the right to withdraw from the contract in the event of incorrect or improper self-supply, provided that the non-delivery is not attributable to the Seller.
5.5 If the Seller offers collection of the goods, the customer may collect the ordered goods during the specified business hours.
5.6 Vouchers are provided to the customer by email or by post.
6. Retention of Title
If the Seller performs in advance, ownership of the delivered goods remains with the Seller until full payment of the purchase price owed.
7. Liability for Defects (Warranty)
7.1 Unless otherwise stated in the following provisions, the statutory provisions on liability for defects apply.
7.2 If the customer acts as an entrepreneur, the Seller has the choice of the type of subsequent performance. For new goods, the limitation period for defect claims is one year from delivery of the goods. For used goods, defect claims are excluded.
7.3 The above limitations of liability do not apply to claims for damages and reimbursement of expenses, to defects fraudulently concealed by the Seller, or to mandatory statutory claims.
7.4 If the customer is a merchant within the meaning of the German Commercial Code, the customer is subject to the commercial duty to inspect and give notice of defects pursuant to Section 377 HGB.
7.5 Consumers are requested to report obvious transport damage to the delivery service and inform the Seller accordingly. Statutory claims remain unaffected.
8. Liability
8.1 The Seller is liable without limitation in cases of intent or gross negligence, injury to life, body or health, warranty promises and mandatory statutory liability.
8.2 In the event of negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage.
8.3 Otherwise, liability of the Seller is excluded.
8.4 The above liability provisions also apply to the Seller’s vicarious agents and legal representatives.
9. Special Conditions for Repair Services
9.1 Repair services are performed at the Seller’s place of business.
9.2 The Seller provides its services at its own discretion or through qualified personnel. The Seller may also use third parties to perform the services.
9.3 The customer must provide all information required for the repair, in particular a comprehensive description of the fault.
9.4 Unless otherwise agreed, the customer must send the item to be repaired to the Seller’s place of business at their own cost and risk.
9.5 Return shipping is carried out at the customer’s expense. At the customer’s request, the Seller may arrange transport insurance.
9.6 The customer’s statutory rights regarding defects remain unaffected.
10. Redemption of Promotional Vouchers
10.1 Promotional vouchers can only be redeemed in the online shop and only during the specified period.
10.2 Individual products may be excluded from voucher promotions.
10.3 Promotional vouchers can only be redeemed before completion of the order process. Subsequent offsetting is not possible.
10.4 The voucher value cannot be paid out in cash and does not earn interest.
10.5 The promotional voucher will not be refunded if goods paid for in whole or in part with the voucher are returned within the scope of the statutory right of withdrawal.
11. Redemption of Gift Vouchers
11.1 Gift vouchers can only be redeemed in the online shop, unless otherwise stated on the voucher.
11.2 Gift vouchers and remaining balances are redeemable until the end of the third year following the year of purchase.
11.3 Gift vouchers can only be redeemed before completion of the order process.
11.4 Gift vouchers can only be used to purchase goods and not to purchase additional gift vouchers.
11.5 Cash payment or interest on the voucher balance is excluded.
12. Packaging Regulation
In accordance with the Packaging Regulation, we are obliged to take back packaging for our products and ensure its reuse or disposal.

13. Battery Regulation
As an end user, you are legally obliged to return used batteries. Disposal in household waste is expressly prohibited.
Used batteries can be returned free of charge to municipal collection points or local retailers. Batteries received from us can also be returned to us free of charge after use or sent with sufficient postage to Sky Fox GmbH, Alexander-Meißner-Str. 42, 12526 Berlin, Germany.
Batteries containing harmful substances are marked with the symbol of a crossed-out wheeled bin. Below the symbol, the chemical designation of the harmful substance is shown, for example Cd, Pb or Hg.
14. Disposal of Electrical and Electronic Equipment
Old electrical and electronic devices must not be disposed of as unsorted municipal waste. They must be collected separately and disposed of via local collection and return systems.
As a retailer, we hereby inform you that electrical and electronic equipment must be taken back and disposed of in accordance with statutory requirements.
15. Applicable Law
15.1 The law of the Federal Republic of Germany applies to all legal relationships between the parties, excluding the UN Convention on Contracts for the International Sale of Goods.
15.2 For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which the consumer has their habitual residence.
16. Place of Jurisdiction
If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller’s registered office in Berlin.
17. Alternative Dispute Resolution
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
18. Ancillary Agreements, Written Form
There are no ancillary agreements. Amendments and additions to the contract must be made in writing to be effective.
